Terms and Conditions

Proof of Purchase: All returns require the original sales receipt as proof of purchase.
Material Returns:
- Within 48 hours: Unused, undamaged merchandise in unopened boxes will receive a full refund.
- After 48 hours, within 30 days: Unused and undamaged merchandise qualifies for an in-store credit or exchange, subject to a 30% restocking fee.
- Final Sale: Clearance merchandise, remnants, and items marked “as is” or “Final Sale” are non-returnable.
- Refund Process:
  - Credit card refunds are issued to the original card.
  - Cash or check transactions are refunded via corporate check, with up to 14 business days for processing.
Special Orders: No returns or cancellations on special orders, including cut-to-fit items. Special orders must be paid in full at purchase.

Contractor Status: Installation is performed by an independent contractor. This does not affect pricing or warranties.
Damage Reporting: Report any visible merchandise or home damage immediately (within 3 days) by phone and in writing.
Acclimation and Installation Conditions:
- Maintain temperature and humidity within manufacturer specifications.
- Installers need access to electricity and water (tile & vinyl only).
Furniture and Property Responsibility:
- The customer is responsible for moving furniture, unless pre-arranged with the installer for an additional fee.
- The customer should remove items from furniture, dressers, tables, closets, and ensure pianos, pool tables, electronics, and breakables are handled properly.
- City Commercial Floorcoverings is not responsible for damages due to the movement of items.

Product Warranty: All floor coverings are covered by manufacturer warranties, details provided separately.
Installation Warranty: City Commercial Floorcoverings offers a 24-month labour warranty on installations, excluding:
- Carpet: Visible seams.
- Ceramic: Tile/grout cracking due to subfloor deflection or foundation settling.
- Hardwood: Gapping and moisture-related issues.
- Laminate: Moisture-related issues.
- Vinyl: Visible seams.
Exclusions: Damage caused by improper maintenance, moisture, or abuse is not covered.

Eligibility: Warranties apply only to owner-occupied residential spaces and must be professionally installed by City Commercial Floorcoverings.
Limitations:
- Warranties are void for commercial use, abnormal conditions (e.g., water damage, fire), or abuse.
- Claims require the original sales receipt for repair or replacement.
- The warranty applies only to the original purchaser.
Seams and Color Variations: Seams may be visible, and color variations are accepted within industry standards. Hardwood, cork, and bamboo may have natural variations in grain and color.
Existing Conditions: If unforeseen structural issues are found during installation (e.g., termite damage), installation will pause until the issues are resolved by the customer.
Delivery and Installation Delays: City Commercial Floorcoverings is not responsible for delays due to weather, shipping, or other external factors.

Deposits:
- 40% deposit required at contract agreement.
- 50% deposit on special orders and labour-only items.
Final Payment: Balance due before installation. If using financing, the promotional period begins when materials are ordered.
Service Charges: Balances not paid as agreed will incur a 1.5% monthly service charge (18% annually).
Collection Fees: In case of default, the purchaser will pay all costs of collection, including 15% attorney fees.

Responsibility for Site Preparation: The customer must ensure that areas are clear and accessible for installation.
Property of Materials: All materials remain the property of City Commercial Floorcoverings until full payment is made.
Additional Charges: Any extra work, such as floor preparation, take-up of existing flooring, and moving of furniture, may incur additional charges.

Seam Visibility: While City Commercial Floorcoverings will attempt to minimize seams, they may be visible depending on the type of material, lighting, and installation method.
No Liability for Damages: City Commercial Floorcoverings is not liable for indirect, incidental, or consequential damages arising from installation or product use.
Structural Integrity: The customer must ensure that subfloors meet installation requirements; problems arising from subfloor conditions are not covered by warranty.
